Terms of Use

These terms govern your use of endofcharity.com, the podcast, our published research, and any material you send us. By using the site or sending us material, you accept them. Last updated 1 November 2026.

The End of Charity is published by Rayeon Associates, in collaboration with Wish Fairy Incorporated. In these terms, 'we', 'us' and 'our' mean Rayeon Associates as publisher. Advisory services described on the Collaborate page are provided by Rayeon Associates or Wish Fairy Incorporated separately, under their own written agreements.

What we publish, and what it is not

Everything on this site and in the podcast is journalism, research and commentary. It is not legal, tax, accounting, financial, investment or professional advice, and it is not a substitute for advice from someone qualified to give it on your facts. We write about tax policy, charitable receipting, disbursement rules and foundation governance, and nothing we publish should be acted on without your own professional guidance. Our advisory services are engaged separately under their own written agreement, and those agreements, not these terms, govern that work.

We take accuracy seriously. We also publish contested figures, forecasts and arguments, and some of what we publish will be wrong. We make no warranty that the content is complete, current or error-free, and we may correct, update or withdraw anything at any time. Where we cite third-party research, the source is responsible for its own data. Where we link to another site, we do not control or endorse it.

Material you send us

If you send us a letter, a voice note, a tip, a document, a topic suggestion, or a free-text survey answer, you remain the owner of it. You do give us a non-exclusive, worldwide, royalty-free licence to reproduce, broadcast, quote, edit for length and clarity, publish and archive it in connection with the podcast and our research, including in aggregated or anonymised form. We will ask before we attribute anything to you by name, and we will honour a request to be anonymous or to withdraw before publication.

When you send us material, you confirm that it is yours to send, that you have not breached a confidentiality obligation, a non-disclosure agreement or an employment term in sending it, that it does not disclose someone else's personal information without their knowledge, and that to the best of your knowledge it is true. You agree to indemnify us against any claim, loss, damage or cost, including reasonable legal fees, arising from a breach of those confirmations or from our publication of material you sent us in reliance on them.

Please do not send us anything you are contractually barred from sending. If you are unsure, tell us what you have and we will discuss it before you send it.

Using our content

The site, the podcast, our reports, our survey instrument and the design of this site are our intellectual property or are used with permission. You are welcome to quote us, cite us and link to us. Please attribute us by name and link back where the format allows. You may not republish a report or an episode in full, present our findings as your own, use our material to train a commercial model, or use our name or marks to imply we endorse you, without our written permission. Journalists, researchers and students do not need permission for fair dealing, and we will usually say yes to anything else if you ask.

Survey findings may be cited freely with attribution to The State of the Canadian Fundraiser Survey and the year of publication.

Using the site

Do not attempt to breach the site's security, scrape it in a way that degrades it for others, submit the survey repeatedly or fraudulently in order to distort the findings or improve your odds in the prize draw, or use the site to send anything unlawful. We may block access and void a prize draw entry where we have reasonable grounds to believe this has happened.

Limits on our liability

We provide the site and its content as they are. To the fullest extent the law allows, we are not liable for any indirect, incidental, consequential or economic loss arising from your use of the site or your reliance on anything we publish, and our total liability in connection with your use of the site is limited to one hundred Canadian dollars.

Nothing in these terms excludes or limits any liability that cannot lawfully be excluded or limited. In particular, and without limiting that sentence, nothing here excludes or limits our liability for intentional or gross fault, or for bodily or moral injury, under article 1474 of the Civil Code of Québec, or any right you have under applicable consumer protection legislation.

Right of reply

Institutions and individuals named critically on the podcast are offered a right of reply, as set out in our Editorial Independence Policy. If you believe we have published something about you that is inaccurate, write to hello@endofcharity.com and we will deal with it promptly. We would rather correct an error than defend one.

Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms.

Governing law

These terms are governed by the laws of the Province of Ontario and the laws of Canada applicable there, and the courts of Ontario have non-exclusive jurisdiction. If you are a consumer resident in another province, this does not deprive you of the protection of the mandatory rules of your own province.

Changes

We may update these terms. The version in force is the one on this page, and the date at the top tells you when it changed. Continuing to use the site after a change means you accept the updated terms.
